Seven checks to run before you file another claim

The situation

Filing again can help, but it can also trigger a new exam of an existing rating. Run these checks first.

1–2. Know your protections

  • Ratings held 20 years or more can't be reduced below that level except for fraud (38 CFR 3.951).
  • Ratings held 5 years or more need stronger proof of sustained improvement to reduce (38 CFR 3.344).
  • Service connection held 10 years is protected except for fraud (38 CFR 3.957).

3. Is anything actually worse?

Only file an increase if symptoms have worsened and the record shows it. Otherwise a new exam could find improvement.

4. Are dependents on your award?

Add them with VA Form 21-686c if you're rated 30% or higher.

5. Are you missing secondary conditions?

See secondary claims.

6. Check effective dates

File an Intent to File first so you don't lose months while gathering evidence.

7. Line up evidence and help

Recent treatment notes, a statement, and a VSO review before filing. Use our checklist.

Get free help

You never have to pay to file an initial VA claim. Free help: a VSO such as DAV, VFW or the American Legion, or a VA-accredited representative.

Educational only, not legal or medical advice. We are not VA-accredited. No one can promise an outcome; VA decides each claim on its own evidence. Rules and rates change; check the linked VA and eCFR sources.
